These terms govern the custom automation and AI tooling services provided by Diya Hussein. By engaging my services, you agree to them.
01 Who I am
I'm Diya Hussein, an independent software developer based in Timișoara, Romania, operating as Diya Hussein — Custom Automation & AI Tools ("Provider", "I", "me"). These Terms apply to the services I provide to clients ("Client", "you").
02 What I do
I design and build custom software that automates repetitive work. Typical projects include:
- Content and social automation — scheduled posting to Instagram, Telegram, Discord and similar platforms
- AI image and video generation pipelines (for example ComfyUI), run on local hardware
- 3D model and design-asset generation
- Desktop tools and applications, packaged as standalone executables
- Automated reports, data pipelines and integrations between tools
Every system is built to the specifications agreed in writing for each project. I do not sell pre-made, off-the-shelf products unless described as such.
03 What I do not do
I do not:
- provide financial, investment, legal, tax or any other regulated advice
- hold, manage or transfer Client funds
- guarantee any specific business outcome — such as follower growth, engagement, reach, sales or revenue
- provide hosting, cloud infrastructure or server maintenance unless stated in the project scope
My systems are operational tools. How you use them, and any results you obtain, are your responsibility.
04 Ownership
On full payment, you own the delivered system and its source code outright and may use and modify it for your own purposes indefinitely. I retain ownership of general-purpose libraries, frameworks and reusable components created before or independently of your project; these are licensed to you as part of the delivered system but remain mine to reuse. You keep full ownership of your own data, content and brand assets.
05 Platform rules & acceptable use
Some automations interact with third-party platforms (for example Instagram / Meta, Telegram, Discord). Those platforms set their own terms, which can change and may restrict automated activity. You are responsible for using each system in line with the relevant platform's terms and applicable law, and for the standing of your own accounts. I am not responsible for account suspensions, bans, rate-limiting or other actions taken by third-party platforms.
06 Payment
- Unless agreed otherwise, projects are billed 50% before work begins and 50% on delivery.
- Fees are quoted per project, in euros (EUR).
- Payment is by bank transfer or card (for example via Revolut); details appear on each invoice.
- Build fees are non-refundable after the acceptance period (see section 08).
07 Care plans & monthly retainers (optional)
Beyond the one-time build, ongoing work can be arranged on a recurring monthly basis — either a care plan (monitoring, breakage fixes and platform-change updates for systems that run against live platforms) or a monthly retainer for continued support, account management, new features and additional automation work. These recurring arrangements:
- are entirely optional and never required to own or run your system
- are billed monthly in advance and can be cancelled at any time
- do not change your ownership of the delivered system
Self-contained tools (for example a one-off generator or report) can be delivered as a one-time build with no ongoing plan, or kept on a retainer if you want continued updates and support.
08 Delivery, acceptance & support
- I deliver each system as defined in its project scope. Timelines are estimates; delays caused by missing information, access or feedback extend them accordingly.
- You have 7 days from delivery to test and report defects. If nothing is reported, the system is considered accepted.
- One-time builds include a 30-day bug-fix period at no extra cost. New features, changes or support beyond that are billed separately or covered by a care plan.
09 Third-party services
Systems may depend on third-party services and APIs. I am not responsible for their availability, accuracy, pricing or terms. You are responsible for maintaining your own accounts and access with them.
10 Limitation of liability
Each system is provided "as is", without warranty of uninterrupted or error-free operation, or of compatibility with future third-party changes. I am not liable for indirect or consequential losses, losses caused by third-party platform or service changes or actions, or losses arising from misuse or modification of a system. My total liability for any project is limited to the fees you paid for that project.
11 Confidentiality
I keep your data, credentials and business information confidential and will not share them with third parties. You agree not to publish or share a system's source code or technical implementation. Either party may mention that the project exists, in general terms, for portfolio purposes.
12 Termination
Either party may end an engagement in writing. If you cancel before delivery, completed work is invoiced and any prepayment beyond that is refunded. If I cancel before delivery, your materials and any payment for unfinished work are returned. Clauses on ownership, confidentiality and liability survive termination.
13 Governing law
These Terms are governed by the laws of Romania. Disputes will first be addressed through good-faith communication before any formal proceedings.
14 Changes
I may update these Terms. The version in force is the one published here on the date of your engagement; the "last updated" date above shows the current version.
